The agreement
These terms are between you and Miles Media of Pittsburgh, PA, which makes and runs Smile Fitter. They apply when a dental practice installs or uses Smile Fitter, and when anyone uses a smile preview or smilefitter.com. By doing any of those, you agree to them. If you're accepting for a practice, you confirm you're allowed to.
The service and the beta
Smile Fitter lets a practice's website visitors preview a new smile with AI, then send the practice their details and a consultation request. It includes the preview pages, the embed script, the lead dashboard, demo pages and Practice Scan.
Smile Fitter is in beta. It works and real patients use it, but we're still changing it. Features may be added, changed or removed, and there may be interruptions. We'll tell practices about changes that affect how they use it.
Fees
Smile Fitter is free while it's in beta. We'll give you at least 30 days' notice by email before any paid plan starts. You decide then whether to keep it. Paid plans will only apply to a practice that agrees to them.
What practices agree to
- Present previews as we provide them, with the AI illustration label, the consent checkbox and the disclaimers left in place.
- Not describe a preview as a diagnosis, a treatment plan or a promised result, in conversations or in marketing.
- Not use a patient's preview or photos in advertising, on social media or in a gallery without that patient's separate written permission.
- Handle leads lawfully, including privacy laws that apply to your practice, HIPAA where it applies, and consent rules for marketing calls and texts. Only send marketing to patients who checked that box.
- Install Smile Fitter only on websites you control or have permission to change.
- Keep your dashboard key private, and tell us right away if you think someone else has it.
- Stay responsible for your own advertising, including compliance with FTC rules and your state dental board.
Using a smile preview
- You must be 18 or older.
- Only use photos of yourself, or of someone who has agreed.
- A preview is an AI-generated illustration of one possible look. It isn't a diagnosis, a treatment plan or a promise of results. What's right for you depends on an exam by a dentist.
- Asking for a consultation doesn't commit you to any treatment.
Fair use
Don't overload, scrape, probe, copy or reverse engineer Smile Fitter, get around its limits or bot check, upload anything unlawful, or use it to make images of people without their agreement. We may block access that does.
Demo pages
To show a practice what Smile Fitter would look like, we may build a demo page using public information about that practice, such as its name, logo, address, phone number, hours and doctor. Demo pages aren't indexed by search engines and are only shared with the practice. If you're a practice and want yours taken down, email [email protected] and we'll remove it within two business days.
Ownership
Smile Fitter, its software, design and content belong to Miles Media. Your practice's name, logo and content stay yours; you let us display them on your preview and demo pages while you use Smile Fitter. The previews a patient makes are theirs to keep and share.
Data
Leads collected for your practice belong to your practice. We handle them on your behalf under our data processing terms and privacy policy, which are part of these terms. Smile Fitter doesn't currently include a HIPAA Business Associate Agreement. If your practice needs one, don't use Smile Fitter with patients until we've signed one with you.
Warranty and liability
Smile Fitter is provided as is and as available, especially during the beta. We don't promise it will be uninterrupted or error-free, or that it will bring a particular number of leads or patients. Previews are AI illustrations and may not be accurate for any individual.
To the extent the law allows, Miles Media isn't liable for indirect, incidental or consequential losses, such as lost profits or lost data, and our total liability for any claim about Smile Fitter is limited to the greater of what you paid us in the 12 months before the claim or $100.
Practices agree to cover Miles Media against claims that come from the practice's own advertising, treatment decisions, or use of patient details or photos in breach of these terms.
Ending service
A practice can stop at any time by removing the script tag or asking us to switch its page off. We can end service with 30 days' notice, or right away if these terms are seriously broken. When service ends, we delete the practice's leads within 30 days after it asks us to, and we'll give you an export first if you want one.
Changes to these terms
We'll update the date at the top when these terms change, and email practices using Smile Fitter about anything significant before it applies to them.
Law and contact
These terms are governed by the laws of the Commonwealth of Pennsylvania, and disputes go to the state or federal courts in Allegheny County, Pennsylvania. Questions: [email protected].
